NOVEDADES LEY DE URBANISMO DE LES ILLES BALEARS (LUIB)

Baleares fue hasta hace unos meses, la última comunidad autónoma de España en tener una ley de suelo propia. Pocos años después de su entrada en vigor, en 2014, ha sido derogada por la Ley de urbanismo de les Illes Balears 12/2017, con fecha 29 de Diciembre.

La ley se ocupa de las tres áreas básicas del urbanismo:

  • La Planificación
  • La Gestión
  • La Disciplina

Vamos a exponer a continuación las principales novedades en cada una de sus áreas:

La principal novedad de la nueva Ley en materia de planificación consiste en simplificar el procedimiento de aprobación de los planes generales a costa de reducir su contenido, que se limitará a cuestiones generales y aspectos estructurales de ordenación del territorio en el ámbito municipal (memoria, normativa urbanística y planos a gran escala).  El desarrollo se realizará a través de los llamados planes de ordenación detallada, cuya aprobación definitiva corresponderá a los propios ayuntamientos en municipios de más de 10.000 habitantes.

En el apartado de gestión urbanística se introducen algunas novedades como la posibilidad de que intervengan terceros no propietarios en los sistemas de cooperación / compensación y se regula con mayor detalle la actuación en suelos urbanos siguiendo las pautas marcadas por la legislación estatal.

Por último, en el apartado de disciplina urbanística destacamos dos novedades:

La no prescripción de las infracciones en suelo rústico (hasta ahora esta previsión solo afectaba al rústico protegido) y la posibilidad de sancionar al personal competente de la administración pública que permita la indisciplina con conocimiento de causa.

Dentro de la mayor complejidad normativa a la que está sujeta el sector, destacamos el asesoramiento integral en la materia que puede prestar Ares Gestión en las diferentes áreas del urbanismo.
